Is it rape if you have sex with someone who is drunk?

So do you believe its rape if you have sex with someone who is drunk and they agree to it while drunk but regret it later. There have been several cases in the past were women have gotten drunk and then agreed to have sex while drunk and then decide they regret it so they get the man charged with rape do you believe that if someone gets drunk and agrees to have sex that they should be able to punish the person they had sex with?

yup, it can indeed be rape.  the argument being that a "drunk" person can't actually give consent. I mean, hey, they're drunk, that's the point. Of course every situation/instance is unique (i.e. the circumstances).

Well when you drink you are responsible for the fact that you become irresponsible. So it's not rape unless somebody activly let you drink something you didn't know you was drinking or put something in your drink.
But If you didn't want to have sex, you could have still had some rationality to say no. 

 

well i think its rape if the person is passed out or barely able to walk. hmm also if both of them are drunk is it alright? i think it might be rape if someone is drunk and the person is not and takes advantage of the other person.

^agreed. you get a DUI for driving drunk, you might feel bad about it later, but in the end nobody made you drink (unless they did 0_0)  Can't handle the booze the don't try to handle it.

hahhhh..........the point here is what's referred to as "diminished capacity" to make a reasoned decision (i.e. consent).........that's how it "can be" rape. Not making a blanket statement, just pointing out the reasoning of how, yes, it "can be" rape.

 

Loooots of people have committed crimes and done horrible things while under the influence.............things they in all likelihood wouldn't have done if they weren't (blasted out of their minds). 

 

Same issue..............someone saying "yes" when they're shit-faced drunk may not be fair to take advantage of when it's being  looked at after the fact by a jury of your peers................all of whom won't be drunk. :)

I feel that consent is only believable when the person is at a normal state of mind/being. 

 

Drunk is not normal. So yeah, I'd lean towards drunk consent is not "true" consent.

And no. You're the one most responsible for yourself. Saying that consent while drunk is questionable, and you can't control yourself when you're wasted, then why would you even drink with questionable people in the first place?

mmmm~ if the person is completely drunk, and cannot even talk right, then its a no.
yes, this person wanted to drink but its not right if (s)he is wasted and a sober person took advantage of that.

now, if the person is only a bit drunk but is still rational, then its not rape.

If I were to get pregnant unwillingly, I would also get an abortion.

But that's just me. I don't feel guilt in interrupting the development of an unborn fetus.

 

Good thing I don't have to worry about all that.
