Not with Disney around... But I agree with your assessment. Most things are plagerized either from things written well after 50 years from the writer's death, or from someone who plagerized from them already (which, therefore, doesn't break copyright...) Also, by most things, I mean when people are stating someone stole an idea (and it isn't the publisher), and with regards to this style of writing or contextual background (fantasy fiction).
